I realize the blog has been tossed a bit to the wayside as the last year has propounded the dust of a freight train racing down the track of our "Immortal" quest.
Granted Facebook has been a great outlet for getting the word out to all of our friends and supporters but as our story grows, our blog has really called out to us to carry our words to the world. And some of these words that we wish to share with you are the actual experience of our journey.
What started as a quest to regain ownership of Tom's infringed screen play evolved into helping other writers in the same situation as us. But it didn't stop there. The process of seeking the assistance of the justice system to regain Tom's credit to his genius screen play, opened us to a deeper level of road blocks that writers as well as other individuals face when traversing the justice system to find justice.
It is our desire to share with others the visceral experience that we are walking and the challenges we are facing as we deal with the courts and what it is like to be a Pro Per person in the court system. What we have learned has been so valuable. How amazing would it have been to have the knowledge we have now when we started this whole train ride in 2010! So the next best thing is to share it with others who may be going through some of the same things we have gone through.
The main thing that we would love to say is that we appreciate each and everyone of you and your support is a fuel that feeds our passion and keeps us going.
In 2010, Tom Althouse went into a legal battle with one of the top film studios, Warner Bros.
Tom Althouse’s script The Immortals was used to make the major blockbuster Matrix Trilogy. What started as a simple journey to regain the rights of a stolen screenplay has turned into the revelation of a conspiracy involving one of the biggest names in Hollywood today. What we are standing in front of now is information mapping a system that the studios use in order to basically take what they want.
This should have been a simple open and close case. Copyright infringement law rests on two major details. The first being access. Did the accused party have sufficient access to the works in question? (click here to see the direct access to WB) And secondly are similarities. Did the copied work carry the signature of the stolen material? (click here for full list of similarities) Now I just want to make a note that according to District Court 9, in cases where absolute access is proven, then less similarity needs to be shown because it is assumed that the work was taken from.
Therefore when you have absolute access, over 190 matching similarities and have your personal information hidden in the movies in question, but your case still goes horribly wrong just as the Althouse VS WB case, then we need to start looking at the details why.
It is a highly known fact in the industry that even having some semblance of a case produces settlement talks in order to save the trouble of a lengthy court battle. But this case is an example of what happens when you have indisputable overwhelming evidence that can roll heads. The reason why there was no settlement was because they knew they had an unwinnable case so they bought off Althouse’s attorney and smeared him in the media.
From the start of the case there was a media blackout headed by their very own news source TMZ which fed all the other news sources going worldwide. Their slanderous title calling Althouse "Just a Hack” set the tone of the campaign against an award winning writer, while at the same time they blocked all positive comments in favor of Althouse on their news sites. Not only that but the TMZ head of legal was also the head of legal against this case! They used their own news source to defame the true writer and shut out the media from the story.
If we would have been able to present this case to the courts justly, so many questions would have been answered. Here we could go into the details of the meanings locked inside the film like how to balance the equation, what the true energy source was that was being harvested, the rule of the one world order and on and on. The Wachowski’s were not writers. Therefore they didn’t know the layers to what they were stealing and instead they cut it up adding their kung fu and anime leaving the audiences confused and empty with an unraveled convoluted and unexplained story.
The inspiration for The Immortals came from Tom Althouse’s real life experiences. (see article here) Not some comic book like the Wachowski’s are into. This is the tip of the iceberg of a compelling story in its own right that is needing to be told. That writers everywhere might benefit from this unfortunate tale of corruption and greed. This is also a warning of the current condition of not only the film industry but our legal system as well.

Was The Immortals more than just a great story?
Since the birth of The Immortals in 1992, Tom Althouse only in the last few years has even become aware of the huge impact and significance that lay hidden in the words and images of his screenplay.
The old adage of life imitating art or vice versa is brilliantly shinning through the example of Tom's body of work that was written as an outlet for the annihilation and suffering poured upon him by the religious right in the early 90's.
A society based on the outline of Hitler Reich and now the Religious Reich. A One World society. Humans as pawns. Manipulating faith for a self serving purpose. Was this fantastical ideas that were just fiction stories? In 1992-1993 yes! This was a fictional expression of Tom's awakening into the inner workings of the Religious Right. But how is it now that in the last 10 years mountains of information has come forward revealing the truth in this very agenda!
For truth seekers out there, you can download that mountain of information through the open sources that we have available to us now. We are fighting an uphill battle against the regime that holds the power of the media industry, the court systems and the power structure that holds the reigns of the finances. But we are the true power. Let's use our voice to speak out and break free for not only the writers but all creative minds that are propelled by their heart to create a better world.

Welcome to the true story that lies at the bottom of the rabbit hole.
A story filled with lies, theft, deception and conspiracy. A story that will leave anyone wondering if true justice can ever come forward, and can we really take down the machine.
We are the ones that have been lied to, stolen from, raped and robbed at the hands of a machine called Warner Brothers. The pinnacle of Hollywood power.
In 1992 Tom Althouse began writing a script that was based on his life experiences during a very dark and hard time. This screenplay was his creative release and healing from a situation that had destroyed him and his world around him. By 1993 it was complete and through a serendipitous connection he was invited up to NY in the beginning of 1993 to pitch his screenplay at the home of Leny Coco to a Warner Brothers Executive.
Everything snowballed from there. The WB exec was blown away. He repeated over and over to Tom that Tom needed to submit it right away because Warner Brothers was going to make it. Tom was given very specific instructions on how to submit his screenplay. He proceeded to follow each of these instructions to the T. The copyrighted script was sent registered mail through an attorney to the WB Story Department directly and by June of 1993, it was in WB’s hands. Needless to say Tom was elated. A dream come true! But it was a dream that was soon going to turn into a far worse nightmare than the experiences that had even inspired the film.
The Access Timeline...
Access to Tom Althouse’s script The Immortals is undeniable and irrefutable!
But this is where the story starts to bend your mind taking you even further down the rabbit hole to places beyond the mind. This is the web of corruption that has knitted our film industry so tightly but now it is time to reveal what lies inside.
What Went Wrong?
Tom followed up with Warner Brothers numerous times after submitting his script. Like a bubble that had popped, he believed that they had just decided not to make his film. During one conversation he had on the phone with Diane Bellis, she answered the phone saying “I know who you are. Next time send it through an attorney so we are both protected.” What did this mean? Tom was dumbfounded by such a statement because he had sent it though an attorney and through registered mail. And protected from what?
It wasn't until nearly 20 years later that it all began to make sense. How his screenplay had been stolen and chopped and used to make the Matrix Trilogy and who knows how many other films. And how Tom's story had been revolutionary, just as the WB Executive had said at the pitch so many years earlier, and it really had changed the face of film as we know it today.
We are here to share with you how this script went from the desk of Diane Bellis in the WB Story Department into the hands of Joel Silver, Andy and Larry Wachowski and onward to the production of the films themselves. A trail that shows more than just the almost 200 matching similarities between The Immortals and The Matrix Trilogy but also the corruption and conspiracy inside the web of lies at the bottom of the rabbit hole not only in WB itself, but inside the court system that is meant to protect us and bring justice.

Access is everything with copyright law. Having a clear path of access means that less emphasis is even placed on matching details and summaries.
What is a copyright case supposed to even look like?
You can even see above that District 9 court in LA itself quotes the “inverse ratio rule” which states that the more the access, the less the proof of match ups are needed, in so far as to say, that if the access is direct and compelling, than it will be assumed they stole from the work, since it is in essence right in front of them.
Access is key. To have over 200 similarities and match ups is just icing on the cake.
Plus to have discovered that in the first time in history, the parties that stole the work and became famous off of it inserted your name, father’s name, birthday and high school into the film for the bio entries of the main character they named after you, and show it for a split second, upside down while the page is turning. This is in no other than the famous interrogation scene of the Matrix when VHS freeze framing would yielded no chance for a clear image of the entries and it flashes by the film for a brief split second on two occasions.
The only way you can lose such a case with straight tort copyright law is… if you have an attorney that is bought out by the other side. This is exactly what occurred and is ongoing. An attorney who will steer the press away, and even alter and tamper with evidence for the other side and as he said “give them anything they want and be done with it.”
Going against an industry giant like WB, it is easy to see how the resources are available to them to even get an opposing councils attorney to work for them.
But imagine being the script writer who is just trying to get back what is rightfully yours, a scriptwriter who is not an attorney or even versed in the copyright law, but believes that justice can happen with the overwhelming evidence you have.
And over the course of the case process it becomes virtually impossible to even know your attorney is steering the case in favor of the defendants. When your attorney is placating you, telling you that you have time, everything is going great, it will be no problem to get depositions and discovery from the other side, it will be no problem to show your evidence and tell your story. Telling you that you have plenty of time but at the same time keeps stalling and stalling and stalling. Unbeknownst to you your time is running out, deadlines are being missed.
Your case is being misrepresented and you don’t even know it because the one person you trust is working against you, giving all your information to the other side while allowing them to give you none of what they bare required by law to provide and disclose. Then you find out they have none and are bragging how they have your attorney in their pocket openly.
Now at the bottom of the barrel, at the midnight hour, you get word from someone in the court itself, that they have heard first hand that the WB attorneys where bragging that they had your attorney in their pocket!
This sounds more like a nightmare than a court case but this is exactly what has happened in our case of Althouse vs WB, Wachowski’s and Silver.
And even when a new attorney was found who was able to shed light on the fact that none of the evidence was submitted, nothing was filed, and that the case was pretty much a lost hope because our previous attorney had sabotaged the case so well. We find that we are sitting in a position of being stolen from again.
It has now become a case of busting down the doors and showing what is going on for playwrights and writers everywhere. How the film industry is in bed with the courts in CA and how it is virtually impossible to even find an attorney that can take your case due to the connections they have in the industry.
We are here to get the word out. To take something that has so many layers and is so intricate in how detailed this case is, and show how copyright law has been twisted, but how the true artists can take it back.
